a) Improper Means to Obtain the Writer Benefits Writer Benefits are provided to the writers in consideration of qualified content only. If the writer has obtained the Bonus through inappropriate means, the Bonus incentive for that month will be rejected.Please note that all discrepancies will be noted and writers will have to rectify events within the week. Should there be a second occurrence, this will result in the writer losing all rights to qualify for the writer's benefits. However, please note that should the matter be grave from the first occurence,Stary will not hesitate to cancel the writer's rights to the all writer's benefits entirely. Where the writer has used improper means to obtain any of the Writer Benefits, Stary may take any of the following actions against excess benefit amounts accrued or paid to the writer to enforce Stary’s rights pursuant to any applicable Writer Benefits rules, regardless of whether any of the Writer Benefits have been actually paid: Claiming from the writer excess benefits amount already paid. Deducting or setting off excess benefits amount from any current or future sum payable to the writer. Disqualifying the writer from receiving additional benefits and/or writing contest awards for three months or longer. Claiming damages from the writer for Stary's losses. Pursuing any other legal or equitable remedies that may be available to Stary under all applicable laws. Examples of improper means include but are not limited to the following: publishing content that infringes on the intellectual property rights of others, plagiarizing the writer's own prior works or prior works of others, uploading irrelevant content (symbols, lyrics, movie reviews, garbled characters, meaningless words, etc.) or duplicate content, unreasonably modifying or deleting a large amount of published content, or violating any other Stary's Writer Benefits rules. b) Failure by the story to meet any of Stary’s standards and requirements To bring our readers a better reading experience, and to reward stories that are truly compelling, wonderful, and captivating, only the story that complies with Stary’s standards and requirements while passing Stary’s editorial review can be eligible for Writer Benefits. Accordingly, Stary has the right to require the writer to rectify the content if the content does not meet Stary’s standards and/or requirements, provided that (a) the story will not be eligible for any Writer Benefits during the rectification period; (b) the story will not be eligible for any Writer Benefits if (1) the writer fails to complete the rectification process within the time frame agreed upon with the editor or (2) if the rectified story is still unable to pass the editorial review. For reference, here are some basic standards and requirements of editors in their review of manuscripts. To clarify, the following is intended to be examples only and not exhaustive. -The story has a basic outline and should be the writer’s original creation, not an imitation or a work of plagiarism. -The main storyline is clear, the plot is coherent, and without irrelevant content. -Plot and character creation are coherent, without incorporating sensitive elements such as religious and political issues or personalities. -Neat and compelling in writing, without duplicate content and meaningless description. *Please note that this new Writer Benefit Rules are retroactive in effect. Stories that signed up with Stary before the effect date of this new Writer Benefits Rules but are deemed poor in content quality must be rectified on or before December 31, 2022, and be approved by the editor, or will be disqualified from the Writer Benefits entirely. c) Where applicable, violation of any term of the exclusive license agreement with Stary The Writer will be disqualified from all Writer Benefits when he/she breaches any term or conditions of the exclusive license agreement, if applicable, entered into with Stary. Examples of violation include licensing or posting any story, that has been signed with Stary exclusively, to any third party’s platform without Stary’s prior written consent. In addition to the disqualification of Writer Benefits, STARY reserves the right to claim indemnification and pursue any other legal or equitable remedies (including but not limited to, a claim for refund of all Writer Benefits bonus) against the violating Writer.
