If she does not, she will be in a state of limbo. There is no statute of limitations on murder. She faces life in prison or the death penalty. Given her medical conditions, the death penalty is unlikely. Even life in prison is unlikely. " the district attorney said.
"We can't place her under arrest but she can understand what is going on. " the commissioner said. "We have a dilemma. She can't stay at the hospital. The county jail is ill-equipped to house her. She is not under arrest yet. There are issues with habeas-corpus. We could put her in a nursing home. Nursing homes might be reluctant to house her. There are security issues. " the d.a said.
"What are our options?" Mark asked. "There is a medical facility that she could go to. " the commissioner said. "It is located inside a prison. She would be housed with other inmates. There are constitutional issues where she has not been formally charged. We can have her there with your consent. " the da said.
"If she wakes up, she will be charged. Until then she could remain there. I suspect even if he does make some kind of recovery, she will never be held competent to face trial. She will probably end up in a criminally insane institution. " the d.a said.
